1. Acceptance of These Terms
These Terms and Conditions ("Terms") govern your access to and use of PickMyInjuryLawyer.com (the "Site"), operated by PickMyInjuryLawyer ("we," "us," or "our"). By accessing the Site, submitting a form, or otherwise using our services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
2. We Are Not a Law Firm
Read this section carefully.
PickMyInjuryLawyer.com is not a law firm, is not a lawyer referral service, and does not provide legal advice, legal representation, or legal services of any kind. We are a marketing and lead generation service.
- No attorney-client relationship is created by your use of the Site, by submitting a form, or by any communication with us.
- An attorney-client relationship is formed only when you and an attorney execute a written agreement to that effect.
- Nothing on the Site is legal advice. Information on the Site is general in nature and may not apply to your situation.
- Attorneys and law firms in our network are independent third parties. We do not employ, supervise, endorse, recommend, or vouch for any of them, and we do not evaluate or guarantee their qualifications, competence, licensure, or the quality of their services.
- We do not evaluate the merits of your potential claim. Any indication that you may or may not qualify reflects the preferences of our marketing partners, not a legal assessment.
3. Paid Legal Advertising
This Site is a paid legal advertisement. Attorneys, law firms, and other marketing partners pay to participate and to receive consumer inquiries submitted through the Site. We receive compensation when your information is transmitted to a partner. This compensation may influence which partners receive your information.
4. Eligibility
You must be at least 18 years of age and legally able to enter into a binding contract to use the Site. You may submit information only about yourself. Do not submit another person's personal information without their express permission.
5. Your Submission and Consent to Be Contacted
By completing and submitting a form on the Site and checking the consent box, you:
- Represent that the information you provided is truthful, accurate, and your own
- Represent that the telephone number you provided is a number you own or are authorized to provide
- Provide your prior express written consent for us and our marketing partners to contact you at that number and email address regarding your potential claim, including by automatic telephone dialing system, artificial or prerecorded voice, and text message, even if the number is on a federal or state Do Not Call list
- Acknowledge that consent is not a condition of purchasing any goods or services
- Acknowledge that message and data rates may apply
You may revoke consent at any time as described in our Privacy Policy.
6. No Guarantee of Results
We make no representation, warranty, or guarantee that:
- You will be contacted by an attorney or law firm
- Any attorney will accept your case
- You have a valid legal claim
- You will recover any compensation
- Any particular outcome will be achieved
Past results described anywhere on the Site, if any, do not predict or guarantee a similar outcome in any other matter. Every case is different and outcomes depend on the specific facts and applicable law.
7. Time Limits on Claims
Every state imposes deadlines, known as statutes of limitations, within which a legal claim must be filed. These deadlines vary by state and by claim type, and exceptions may apply. We do not calculate, track, monitor, or advise you regarding any deadline applicable to your situation, and we are not responsible if a deadline passes. Consult a licensed attorney in your state promptly.
8. Accuracy of Information
You are responsible for the accuracy of the information you submit. Submitting false, inaccurate, incomplete, or fraudulent information may result in your inquiry being rejected and may terminate your right to use the Site.
9. Intellectual Property
All content on the Site, including text, graphics, logos, images, design, and software, is owned by PickMyInjuryLawyer or its licensors and is protected by United States and international intellectual property laws. 11. Third-Party Websites and Services
The Site may contain links to third-party websites and services. We do not control and are not responsible for their content, privacy practices, products, or services. Links do not constitute endorsement. Your interactions with third parties are solely between you and that third party.
12. Disclaimer of Warranties
THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT.
WE ARE NOT RESPONSIBLE FOR THE ACTS OR OMISSIONS OF ANY ATTORNEY, LAW FIRM, OR MARKETING PARTNER.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PickMyInjuryLawyer AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, ANY COMMUNICATION WITH A MARKETING PARTNER, OR ANY LEGAL SERVICES YOU OBTAIN.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify, defend, and hold harmless PickMyInjuryLawyer and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Site, your violation of these Terms, your violation of any law or the rights of any third party, or any information you submit.
15. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.
Informal resolution first. Before initiating any formal proceeding, you agree to contact us at support@pickmyinjurylawyer.com with a written description of your dispute and to attempt to resolve it informally for at least 60 days.
Binding arbitration. If we cannot resolve the dispute informally, you and PickMyInjuryLawyer agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Connecticut or, at your election, in your home county, or by telephone or video conference. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. YOU AND PickMyInjuryLawyer AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class proceeding.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may seek injunctive relief in court to protect intellectual property rights.
Your right to opt out. You may opt out of this arbitration agreement by sending written notice to support@pickmyinjurylawyer.com or 163 Oldfield Road, 2nd Floor, Fairfield, CT 06824 within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.
Survival. This section survives termination of these Terms.
16. Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of laws principles. Subject to the arbitration provision above, you consent to the exclusive jurisdiction of the state and federal courts located in Connecticut.
17. Termination
We may suspend or terminate your access to the Site at any time, for any reason, without notice.
18. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PickMyInjuryLawyer regarding the Site and supersede all prior agreements and understandings.
20. Changes to These Terms
We may modify these Terms at any time. The updated version will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms.
